ABSTRACT tout court - - - - ABSTRACT is perceived as a serious societal which pose the question of whether research misconduct should be considered a criminal offence and how would it be possible to proceed in a criminal trial against fraudsters. When discussing these topics, howe- a fact which undermines its possible criminalization. In other words, often the borders between error, miscon- and punishing researchers whose professional behaviour was bad is considerably complicated by this lack of clarity. What is the limit of a bad behaviour? Which is the most appropriate punishment? These questions clearly identify the problem. In this paper, we would like to bring to the attention of the reader some of our ideas on these topics. We would like to explicitely state that misconduct in science is never acceptable, but in order to proceed against serious offences it is necessary to weight the observed behaviour in an appropriate manner. To avoid some dangerous ethical and conceptual traps, we aim useful to examine any allegation of research misconduct. KEYWORDS Research integrity Research misconduct 1. GENI O CATTIVI SCIENZIATI? If the Principia established the quantitative pattern of modern science, it equally suggested a less sublime truth: that no one can manipulate the fudge factor quite so effectively as the master mathematician himself" ad hoc - - ad
